חוזה הלוואה בין מלווה ללווה טעון מסמך בכתב; הסכמת הלקוח לכריתת חוזה ההלוואה תינתן במפורש ותתועד בידי המלווה, ויכול שתינתן בדרך של חתימת הלקוח על חוזה ההלוואה; שר המשפטים רשאי לקבוע הוראות לעניין אופן תיעוד ההסכמה כאמור.
