תיקון: תשס״ח־2
דן יחיד רשאי להרשיע נאשם בעבירת משמעת שאשמתו בה נתגלתה מן העובדות שהוכחו לפניו, אף אם עובדות אלה לא נטענו בכתב התלונה, ובלבד שניתנה לנאשם הזדמנות סבירה להתגונן.
