בבתי הדין יפעל משמר שיחולו עליו הוראות פרק ג׳1 לחוק בתי המשפט [נוסח משולב], התשמ״ד–1984, בשינויים המחויבים; ואולם שר המשפטים, בהסכמת שר האוצר והשר לביטחון הפנים ובאישור ועדת החוקה חוק ומשפט של הכנסת יקבע בתקנות את מבנה הארגון של המשמר ומועד התחילה של הפעלתו.
