5. פיצוי ושיפוי
(א)היה השומר אחראי לאבדן הנכס או לנזקו, זכאי בעל הנכס לפיצויים הניתנים בשל הפרת חוזה.
(ב)לא היה השומר אחראי לאבדן הנכס או לנזקו, אך היה לו בשל אבדנו או נזקו זכות לפיצוי או לשיפוי כלפי צד שלישי, רשאי בעל הנכס לתבוע מן השומר את נזקו מתוך הפיצוי או השיפוי המגיע לשומר.
