2. בדיקה
תיקון: תשס״ה
(א)פקח שמונה לפי הוראות סעיף 5ד רשאי להיכנס למקרקעי ציבור בכל עת סבירה כדי לבדוק את ההחזקה או השימוש בהם וכן את זכותו של המחזיק או המשתמש בהם לעשות כן, והוא רשאי לדרוש מהמחזיק או מהמשתמש להציג בפניו מסמכים שברשותו המוכיחים את זכותו.
(ב)על אף האמור בסעיף קטן (א) אין להיכנס למבנה של קבע המיועד למגורים ומשמש להם, אך רשאי שופט של בית משפט שלום לתת צו המתיר את הכניסה.
