הורשע אדם ובית המשפט מצא שיש ליקוי בכשרו השכלי, רשאי הוא, במקום לגזור את דינו, לצוות שיובא לפני ועדת האבחון כדי שתחליט על דרכי הטיפול בו; החליט בית משפט כאמור, יחולו הוראות חוק זה בשינויים המחוייבים.
