תוך 45 ימים מיום מסירת ההודעה כאמור בסעיף 7(ג), רשאי האדם עם מוגבלות שכלית–התפתחותית, נציגו, הגורם המטפל ועובד סוציאלי לפי חוק הסעד (טיפול באנשים עם מוגבלות שכלית–התפתחותית), לפי העניין, לערור על החלטת ועדת האבחון לפני ועדת ערר.
