54. תחולת הוראות
(א)על ביטוח תאונה, מחלה ונכות שבו חייב המבטח לשלם תגמולי ביטוח לפי שיעור מוסכם מראש, ללא תלות בשיעור הנזק שנגרם, יחולו הוראות פרק ב׳, בשינויים המחוייבים.
(ב)על ביטוח תאונה, מחלה ונכות שבו חייב המבטח לשלם תגמולי ביטוח לפי שיעור הנזק שנגרם, יחולו הוראות סעיפים 42, 49, 52, 56, 61, 62 ו־64, בשינויים המחוייבים.
