14יב. בקשה לביטול התראה מינהלית
תיקון: תשע״ז
(א)נמסרה למפר התראה מינהלית כאמור בסעיף 14יא, רשאי הוא לפנות לממונה על התקינה בכתב, בתוך 45 ימים, בבקשה לבטל את ההתראה בשל כל אחד מטעמים אלה:
(1)המפר לא ביצע את ההפרה;
(2)המעשה שביצע המפר, המפורט בהתראה, אינו מהווה הפרה.
(ב)קיבל הממונה על התקינה בקשה לביטול התראה מינהלית לפי הוראות סעיף קטן (א), רשאי הוא לבטל את ההתראה או לדחות את הבקשה ולהשאיר את ההתראה על כנה; החלטת הממונה על התקינה תינתן בכתב, ותימסר למפר בצירוף נימוקים.
