52. מכירת מיטלטלין המעוקלים בעיקול זמני
תיקון: תשנ״ה, תשנ״ט, תשנ״ט־2, תשס״ט, תשפ״ג
(א)היו המיטלטלין מעוקלים בעיקול זמני שניתן לטובת תובע שזכה בתביעתו, כאמור בתקנות 106 ו־107 לתקנות סדר הדין האזרחי, לא יוצאו המיטלטלין למכירה אלא לאחר שהומצאה אזהרה לחייב וחלף המועד הנקוב בה.
(ב)לעניין תקנה זו, דין מכירת מיטלטלין המעוקלים בעיקול זמני שאישר בית המשפט, כדין מיטלטלין המוצאים למכירה בהליך מימוש משכון.
