10. חזקת שימוש
חזקה על הנתבע כי השתמש בסוד המסחרי שבבעלות התובע, אם התקיימו שניים אלה:
(1)הסוד המסחרי הגיע לידיעתו של הנתבע או שהיתה לו גישה אליו;
(2)המידע שבו משתמש הנתבע דומה דמיון מהותי למידע נושא הסוד המסחרי.
