הפרת הוראה מהוראות פרקים א׳ ו־ב׳ היא עוולה בנזיקין, ופקודת הנזיקין [נוסח חדש] (להלן – פקודת הנזיקין) תחול עליה, כפוף להוראות חוק זה.
