2. מינוי וסמכויות
(א)שר המשפטים ימנה אפוטרופוס כללי, ורשאי הוא למנות משנה וסגן או סגנים לאפוטרופוס הכללי ולקבוע את סמכויותיהם.
(ב)האפוטרופוס הכללי מופקד על ניהולם של נכסים עזובים לפי הראות חוק זה; כן מוסמך הוא לבצע כל תפקיד אחר שקיבל על עצמו או שהוטל עליו על פי דין או החלטת ממשלה.
הממשלה הקימה ועדה ציבורית לקביעת ייעודם של עיזבונות לטובת המדינה (החלטת ממשלה מס׳ 1498 מיום 1.4.1990); ועדת העיזבונות פרסמה נוהל עבודת הוועדה המפרט הליך קבלת כספי ההקצבות.
