נוסף על האמור בתקנה 40, בעד בקרת תכן לביצוע תוספות או שינויים בהיתר בנייה שחלה לגביו בקרה של מכון בקרה אך טרם הוצאה לגביו תעודת גמר, ובלבד שהבניין הכולל את התוספות או השינויים הוא מסוג הבניינים שלגביו חלה חובת בקרה של מכון בקרה, תחושב האגרה לפי שטח הבנייה המתווסף לשטחים שאושרו לפניו במכון הבקרה.
