ניטע טבק בניגוד להוראות סעיפים 3–8, רשאי פקיד בלו לעקרו ויראו את הטבק כטבק מוברח כענינו בסעיף 58, ודינו של מי שנטע טבק כאמור – מאסר שלושה חדשים או קנס חמישים לירות.
