3. יסוד לשימוש בסמכות
תיקון: ק״ת תשכ״ז
(א)רשות מוסמכת לא תתן צו תפיסת מקרקעים או צו דיור על פי חוק זה, אלא בשעת־חירום.
(ב)רשות מוסמכת לא תתן צו תפיסת מקרקעים או צו דיור על פי חוק זה, אלא אם היא משוכנעת שמתן הצו דרוש לשם הגנת המדינה, בטחון הציבור, קיום אספקה חיונית או שירותים ציבוריים חיוניים, קליטת עולים או שיקום חיילים משוחררים או נכי מלחמה.
