40ד. הוכחת אמרה של נאשם
תיקון: תשס״ג
אמרתו של נאשם מותר להוכיח בעדותו של אדם ששמע אותה; נרשמה האמרה בכתב והנאשם חתם עליה או קיים אותה באופן אחר, מותר להוכיחה בעדות על כך ממי שהיה נוכח באותו מעמד; אמרה שנרשמה כאמור מותר להוכיחה אף בתצהיר בכתב של מי שהיה נוכח באותו מעמד, אם הנאשם מיוצג וסנגורו מסכים לכך.
