2. פטור מאגרה
פטור מאגרה לפי סעיף 198(ה1) לחוק יינתן לעורר שהוא אחד מאלה ובלבד שוועדת הערר החליטה שהערר שהגיש מגלה עילה לכאורה:
(1)זכאי להנחה בשיעור של 50% לפחות מסכום הארנונה הכללית, בהתאם לתקנה 2(8) לתקנות הסדרים במשק המדינה (הנחה מארנונה), התשנ״ג–1993 (להלן – תקנות ההסדרים);
(2)נזקק כהגדרתו בתקנה 7 לתקנות ההסדרים.
