5. חילוט ערובה
סבר הממונה, או עובד משרד הפנים מטעמו, כי מעסיק לא מילא חובה שלו כלפי עובדיו הזרים, כולם או חלקם, רשאי הוא לחלט את הערובה שהמציא המעסיק האמור, כולה או מקצתה וזאת לאחר שנתן למעסיק הזדמנות לטעון את טענותיו בתוך פרק זמן סביר, בהתחשב בדחיפות העניין.
