28. תובענה למזונות מן העזבון
(א)תובענה למזונות מן העזבון, שינוים או ביטולם, לרבות בקשת ביניים לקביעת מזונות זמניים, תוגש בכתב לבית המשפט.
(ב)בתובענה יצוין דבר זכותו של התובע למזונות מן העזבון ויפורשו בה, ככל האפשר, הפרטים המצוינים בסעיף 59 לחוק וכן פירוט הכנסות התובע בשנים עשר החודשים שקדמו להגשת התביעה; לתובענה יצורף תצהיר לשם אימות העובדות שעליהן היא מתבססת ויצורפו כל המסמכים התומכים בתובענה.
