8. פטור מהתחייבות לשיפוי המשיב
(א)נדחה תשלומה של האגרה בעד העתירה, או של חלק מן האגרה, ישקול הרשם אם ראוי לפטור את העותר מן החובה להפקיד ערבון או ליתן ערובה לפי תקנה 6(א), לשיפוי המשיב על הוצאות הדיון או על מקצתן, והפטור לא יינתן אם הראה המשיב טעם שלא לפטור.
(ב)החליט הרשם ליתן פטור שלא בפני המשיב או בא כוחו, תומצא למשיב הודעה על כך.
