6. סייג לתחולה לגבי מנפיק מוצרים מובנים
תקנות אלה לא יחולו על מנפיק מוצרים מובנים אם לאחר תחילתן של תקנות אלה עשה אחד מאלה:
(1)הציע לציבור מוצרים מובנים;
(2)התקשר בעסקה עם בעל שליטה או שלבעל השליטה יש בה עניין אישי, למעט אם העסקה תוארה בתשקיף שעל פיו הונפקו איגרות החוב, וטעונה לפי תנאי התשקיף אישור הנאמן שמונה לאיגרות החוב לפי חוק ניירות ערך.
