על גביית מס עזבון תחול פקודת המסים (גבייה) – להוציא סעיף 12 שבה. החייב במס עזבון יראוהו כאדם שעליו הוטל מס, כמשמעותו בסעיף 4 לפקודה האמורה, בסכום המגיע ממנו.
