5. תקופת החזקה
(א)שר החקלאות לא יחזיק באדמה מוברה ולא ימסרנה לעיבוד משך תקופה העולה על חמש שנים מיום קבלת האדמה לחזקתו.
(ב)קיבל שר החקלאות אדמה מוברה לחזקתו, או מסרה לעיבוד, אין הוראות פקודת העברת קרקעות (פרק פ״א) חלות על קבלת חזקה ומסירה לעיבוד כאלה.
