105. תשובת בעל הפטנט
(א)בעל הפטנט ימציא לרשם, תוך שלושה חדשים מיום הגשת הבקשה לביטול הפטנט, את כתב טענותיו ויצרף לו את ראיותיו.
(ב)לא הגיש בעל הפטנט כתב טענות במועד האמור בתקנת משנה (א), יראו כאילו הודה בטענות מבקש הביטול, זולת אם באותה עת תלוי ועומד בבית המשפט הליך בשל הפרת הפטנט או ביטולו ובעל הפטנט הודיע על כך לרשם ובית המשפט לא נתן רשות לרשם לדון בבקשה.
