8. מי שאינו נותן ערבות יהא צפוי למאסר
מי שנצטוה ליתן ערבות עפ״י סעיף 5(2) ואינו עושה זאת לפני התאריך שבו מתחילה התקופה שהערבות ניתנה לה, יאסר, ואם כבר נאסר, יהא עצור בבית הסוהר עד תום אותה תקופה או עד שיתן את הערבות הדרושה בתוך אותה התקופה.
