אב שהוא בעל דעות נפסדות ובעל שיקול דעת רע, או שנידון בפלילים לעונש המונע ממנו ביצוע תפקידי האפוטרופסות לתקופה ארוכה – אינו רשאי למכור את נכסי הקטין אף אם יש במכר זה טובת הנאה לקטין, אלא ברשות מאת הקאדי.
