לא ימונה לחבר הוועדה המייעצת מי שהורשע בעבירה פלילית או עבירת משמעת שמפאת מהותה, חומרתה או נסיבותיה אין הוא ראוי לכהן כחבר הוועדה המייעצת או מי שהוגשו נגדו כתב אישום או קובלנה בעבירה כאמור וטרם ניתן פסק דין סופי בעניינו.
