תיקון: תש״ם, תשנ״ו־2, תשס״ד־2
העובר עבירה לפי סעיף 304 לחוק העונשין, התשל״ז–1977 תוך כדי שימוש ברכב, דינו – מאסר שלוש שנים ולא פחות משישה חדשים; אולם רשאי בית המשפט, אם ראה שהנסיבות מצדיקות זאת, שלא לפסוק מאסר מינימום כאמור מטעמים שיפרש בפסק הדין.
