ביחס לעדות ינהגו בתי־משפט צבאיים לפי החוק [במקור: החוק האנגלי] ולפי נהגם של בתי־המשפט המשמשים בשיפוט פלילי [במקור: בשיפוט פלילי באנגליה]; בתנאי שיהיה בית־משפט צבאי רשאי – אם נוכח לדעת שמעניין הצדק לעשות כן – להרשות כי תובא כל עדות מסויימת, אף־על־פי [במקור: שבאנגליה] לא היו מרשים להביאה, ואולם בכל מקרה ומקרה כזה ירשום ברשומה את הטעמים שהניעוהו לעשות כן.
