178. תביעות הפרה
(א)בעל פטנט או בעל רשיון יחודי – הם בלבד זכאים להגיש תביעה על הפרה.
(ב)בפטנט שבבעלות משותפת רשאי כל שותף להגיש תביעה על הפרה.
(ג)אם בעל הפטנט או חלק מן השותפים בפטנט או בעל רשיון יחודי לא הצטרפו כתובעים לתובענה על הפרה, יצורפו על ידי התובע כנתבעים.
(ד)מי שצורף כנתבע לפי סעיף זה ולא נטל חלק בהליכים, לא יחוייב בתשלום הוצאות.
