הרוכש בתום לב מאחד השותפים מוצר שיש עליו פטנט בבעלות משותפת או מוצר שנוצר בתהליך המוגן על ידי פטנט כאמור, רואים אותו כאילו רכש את המוצר מבעל פטנט יחיד; הטוען שהרכישה לא היתה בתום לב, עליו הראיה.
