165. עונש מוות
(א)למרות האמור בסעיף קטן 164(א) לא יוטל על הנאשם בבית משפט צבאי גזר־דין מוות, אלא אם כן היה מותב בית המשפט הצבאי מורכב משלושה שופטים שדרגתם איננה פחותה מסגן אלוף וגזר הדין ניתן פה אחד.
(ב)לא יטיל בית משפט צבאי עונש מוות על נאשם שגילו, בעת ביצוע העבירה, היה למטה מגיל 18.
