99. החלטות יתקבלו ברוב דעות
החלטות בית משפט צבאי, לרבות הכרעת הדין וגזר הדין, יתקבלו ברוב דעות; לא היה רוב דעות לגבי סוג העונש או מידתו, רואים שופט שהציע את סוג העונש או מידת העונש החמורים ביותר, כאילו הצטרף לדעתו של שופט שהציע את ההצעה הקרובה ביותר להצעתו. לענין סעיף זה יקבע אב בית הדין מהו עונש חמור יותר.
