הוברר לבית הדין עם פתיחת הדיון, כי לא נתמלאו לגבי השבוי דרישות סעיף 104 לאמנה, ידחה בית־הדין את הדיון למועד שבו יתמלאו דרישות סעיף 104 כאמור.
