9. שמירת זכויות
(א)שבוי הנושא עונש שנפסק בדין משמעתי, או הנמצא במעצר לפני משפט, יוסיף ליהנות מן הזכויות המוענקות לו על פי האמנה, למעט מקרים שבהם הנאה זו אינה אפשרית בגלל עצם הישיבה בכלא, ובמידה שאינה אפשרית כאמור.
(ב)על אף האמור בתקנת משנה (א), אין לשלול בשום פנים מאת שבוי כאמור את הזכויות המוענקות לו על פי סעיפים 78 ו־126 לאמנה ואת זכויות היתר הקשורות בדרגתו.
