40. סעיף 40
(1)עונש של יום הוא עשרים וארבע שעות, ועונש של חודש הוא שלושים יום, ומה שעולה על חודש ייחשב מהיום הקובע ועד ליום שבאותו תאריך לפי הלוח הגריגוריאני.
(2)פרט למקרה שבו נשפט העצור לתקופה של עשרים וארבע שעות, השיחרור יהיה לפני צהרי היום האחרון.
