(1)”המניע“: הוא הסיבה הדוחפת את המבצע למעשה למטרה הסופית שאליה הוא חותר.
(2)המניע אינו מהוה מרכיב ממרכיבי העבירה אלא במקרים שנקבעו בחוק.
