89. סעיף 89
אין מענישים מבצע על מעשה שהיה צורך לבצעו כדי להרחיק באופן מידי, מעליו או מעל אחרים, מרכושו או מרכוש אחרים, סכנה חמורה שאפפה אותם ושלא היה הוא שגרם לה בזדון, בתנאי שהמעשה יהא פרופורציונלי לסכנה.
