4. סמכות בית המשפט
הורשע אדם על עבירה לפי סעיף 3, רשאי בית המשפט בשעת גזר הדין לצוות שהבנין או אותו חלק ממנו שנבנו ללא היתר או בסטיה מתנאי ההיתר ייהרס, יפורק או יסולק על ידי הנשפט או הממונה או מי שהוסמך לכך מטעמו, ולחייב את הנשפט בהוצאות הביצוע.
