2. הגבלת סמכות מפקח
מפקח לא יפעיל את סמכותו לפי סעיף 11יד(ב)(2) לחוק לגבי נותן שירות עסקי, אלא בהתקיים אחד מאלה:
(1)נותן השירות העסקי לא נענה לדרישת מפקח לפי סעיף 11יד(ב)(1) לחוק;
(2)התעורר אצל המפקח חשש להפרת החוק או הצו מצד נותן השירות העסקי.
