על אף האמור בתקנה 3, מי שנתקיימו בו הוראות תקנה 1 במשך תקופה של 540 הימים שקדמו בתכוף ליום התחילה, יראוהו, לעניין סעיף 161(א)(1)(א) לחוק, כאילו שולמו בעדו דמי ביטוח אבטלה בתקופה האמורה.
