Section 11 of תקנות הביטוח הלאומי (זכויות וחובות לפי חוק הביטוח הלאומי לשאינם תושבי ישראל), התשמ״ז–1987, סייג לזכאות.
11. סייג לזכאות
קיים ביום שבו קרה המקרה המזכה בגימלה חוב של דמי ביטוח בעד תקופה של 12 חדשים לפחות, לא תינתן גימלה והוראות פרק ט׳1 לחוק לא יחולו; לענין זה, ”היום שבו קרה המקרה המזכה בגימלה“ –
(1)בתביעה לקיצבת זקנה – היום בו נוצרה לראשונה הזכאות לקיצבה;
(2)בתביעה לקיצבת שאירים – היום שבו נפטר תושב האזור;
(3)בתביעה לקיצבת נכות – התאריך הקובע כמשמעותו בפרק ו׳2 לחוק.
