5. תצהיר של אסיר ושל בעל דין אחר
(א)בעל דין שברצונו להשמיע טענותיו בעת שמיעת הבקשה – ימציא לבית המשפט, תוך 10 ימים מיום ההמצאה לפי תקנה 3, תצהיר עם פירוט טענותיו; התצהיר יוגש לבית המשפט במספר עתקים כמספר בעלי הדין ובעוד שני עתקים נוספים.
(ב)אסיר אינו חייב בהגשת תצהיר כאמור בתקנת משנה (א).
(ג)בית המשפט ימציא ליועץ המשפטי לממשלה, לאסיר ולכל בעל דין אחר, זולת מוסר התצהיר, עותק של התצהיר.
