12. מחירי השוק
כל מקום שנאמר בו בכללים אלה שהנזק יוערך על פי מחיר השוק או על פי שוויים, הכוונה היא לסכום שהיה משתלם על ידי קונה מרצון למוכר מרצון בעד נושא הנזק ולא יובא בחשבון הגדלת ערכו של נושא הנזק או הקטנתו בשל פרסום תכנית המפעל או אישורה; ואולם, אם לא ניתן לקבוע סכום כאמור, יראו את שווי הנזק הסכום הדרוש במידה סבירה להטבת הנזק או לרכישת נכס חלופי במקום הנכס שנתפס או הושמד.
