4. נזקים לגידולים חד־שנתיים
נזקים לגידולים חד־שנתיים בעל ושלחין יוערכו לפי הסכום שהיה מתקבל תמורת יבול מדונם גידול כאמור אלמלא ניזוקו בניכוי כל הוצאות עיבוד שלא נעשה בגלל סירוב לתת היתר לפי סעיף 85 לחוק או כל הוצאות עיבוד שלא נעשה מיום שהודיעה רשות המים לבעליהם כדין על הפעולות שהיא התכוונה לעשות במקרקעין שעליהם מצויים הגידולים האמורים, אשר מנעו את עיבוד השטח או הפכוהו לבלתי משקי.
