על אף הוראות סעיף 118 רשאים הרופא או הועדה הרפואית לקבוע דרגה שאינה יציבה, אף בשיעור העולה על הקבוע במבחנים, ובלבד שהשיעור לא יעלה על 100% והוא יכול להיות מלפני היום שבו נקבע, ולעתיד לא יהיה ליותר משנה אחת מהיום שבו נקבע.
