393. תובענה של מעביד בהעדר תובענה של עובד
[231א]
עובד או התלויים בו, שהמוסד דחה את תביעתם לגמלה לפי פרק ה׳ ולא הגישו תובענה לבית הדין לעבודה תוך המועד שנקבע בתקנות, הזכות בידי המעביד להגיש לבית הדין לעבודה, בשמם, תובענה נגד המוסד תוך תקופה שקבע שר המשפטים בהתייעצות עם השר.
