4. קביעת סוג הבנין
(א)היה הדיור החלוף בבנין חדש, יחולו הוראות תקנות 6 ו־7; היה הדיור החלוף בבנין שאינו חדש, יחולו הוראות תקנה 9.
(ב)בתקנת משנה (א), ”בנין חדש“ – בנין שהושלם במועד שאינו מוקדם משנתיים לפני התאריך שבו הציעה הרשות לראשונה דירה בו כדיור חלוף, ויראו את תאריך גמר הבנין הנקוב בתעודת הגמר מאת הועדה המקומית כראיה לתאריך השלמתו.
