6. תנאי הזכאות להשבת נכס
על מבקש נכס להוכיח שני תנאים אלה במצטבר:
(1)קיימת זהות בין הנספה הרשום בבקשה ובין בעל הנכס הרשום;
(2)המבקש זכאי לנכס מכוח ירושה או זכות אחרת שבידו המתייחסת, במישרין או בעקיפין, לנספה הרשום בבקשה.
